EXCPE 1524 - Hearing and Deciding Student Appeals
Course Description
This training is for anyone who is responsible to hear and make decisions on student disciplinary appeals in any Alberta post-secondary institution (PSI). Smaller institutions may have only one person making this decision, while larger ones might train appeal panels. This course uses the term "appeal decision-maker" to encompass anyone who is involved in deciding student appeals. The training is based on a close reading of the Post-Secondary Learning Act of Alberta, and all of the relevant case law. It describes best practice for student appeals, but remember that if your policy differs from the concepts in this course, you must follow your own policy.
Who Should Take This Course?
- 🗸 This course is for anyone with the authority to make decisions on student conduct appeals, whether on a panel or as a single decision-maker.
- 🗸 Additionally, this course is for those who coordinate, organize, advise on and are required to explain appeals in the course of their duties.
- 🗸 The concepts apply in any case of student disciplinary action, from academic integrity to sexual and gender-based violence.
Learning Objectives
By the end of this course, students should be able to:
- 🗸 Understand the complaint process structure and your role within it.
- 🗸 Grasp the legal framework outlined in the PSLA and relevant case law.
- 🗸 Learn how to address procedural requests effectively.
- 🗸 Gain knowledge of the appellate standard of review.
- 🗸 Develop strategies for procedurally fair decision-making that minimizes harm, considering potential trauma.
Notes
The course was developed in the context of Alberta's legal landscape, including, but not limited to, the Post-Secondary Learning Act, the Alberta Human Rights Act, the Freedom of Information and Protection of Privacy Act, as well as applicable case law. Strategies to reduce harm and account for trauma and principle-based practices complement compliance with these and other legal and regulatory requirements to reduce barriers to reporting and support participants in complaint processes.
